1. Overview

This website is operated by Alphamare Pty Ltd trading as Whites Forestry Equipment.

Throughout these Terms, “we”, “us” and “our” refer to Alphamare Pty Ltd trading as Whites Forestry Equipment. “You” and “customer” refer to any person, business or organisation that accesses our website, places an order, purchases from us, or purchases from one of our marketplace listings.

Whites Forestry Equipment operates as an online store with warehouse dispatch only. We do not operate a retail shopfront.

These Terms apply to purchases made through our website and, where applicable, purchases made from Whites Forestry Equipment through third-party marketplaces or other sales channels.

By accessing our website or placing an order, you agree to these Terms to the extent permitted by law. Our Shipping Policy, Refund Policy and Privacy Policy also apply where relevant.

2. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

Depending on the circumstances, you may be entitled to a repair, replacement, refund, cancellation or compensation for reasonably foreseeable loss or damage if a product or service does not meet a consumer guarantee.

Any manufacturer warranty, voluntary warranty, return condition or other promise is provided in addition to your rights under the ACL and does not replace or limit those rights. Consumer guarantee rights may continue after a stated warranty period has expired.

This section applies to every part of these Terms, including pricing, stock availability, promotions, shipping, delivery, returns, warranties, marketplace orders, special orders, services, disclaimers and limitations of liability.

If any part of these Terms appears to exclude, restrict or modify a right or remedy that cannot lawfully be excluded, restricted or modified, that part applies only to the maximum extent permitted by law. Where these Terms are inconsistent with rights that cannot be excluded, those rights prevail.

3. Online Store Terms

You must use our products in accordance with all applicable laws, safety standards, manufacturer instructions and safe operating practices.

Before placing an order, you are responsible for checking that the product is suitable for your intended use and compatible with your equipment.

If you are unsure whether a product is suitable for your chainsaw, guide bar, sprocket, cutting setup, machinery or intended use, please contact us before ordering.

3A. Marketplace Orders

We may sell products through third-party marketplaces and sales channels, including eBay, Meta, Facebook, Google Shopping and other online platforms.

Where you purchase from us through a third-party marketplace or sales channel, your order may also be subject to that platform’s terms, checkout process, payment rules, return process, buyer-protection policies and dispute-resolution procedures.

Marketplace rules may govern the administration of an order placed on that platform, including payment processing, messaging, cancellations, returns and disputes. Nothing in a marketplace rule or these Terms limits rights that cannot lawfully be excluded.

Product descriptions, specifications, compatibility information, pricing and stock availability shown on marketplace listings may differ from our website because of platform formatting, listing limitations, data-feed delays, currency conversion, system updates, errors or stock movement.

If you are unsure whether a marketplace product is suitable for your equipment, contact us through the marketplace messaging system before ordering.

4. Product Safety

Many products sold by us are intended for trained or experienced operators. Incorrect selection, fitting, use, sharpening, maintenance or handling may result in serious injury, death or property damage.

Chainsaw bars, chains, sharpening equipment, cutting accessories and forestry products must be selected, fitted, maintained and used correctly.

Customers must check compatibility with their equipment before use, including bar mount, pitch, gauge, drive-link count, sprocket size, chain type, bar length, powerhead suitability and intended cutting conditions.

Customers must read and follow all applicable manufacturer instructions, safety warnings, machinery manuals and safe operating procedures, and use appropriate personal protective equipment.

To the extent permitted by law, we are not responsible for injury, damage or loss caused by misuse, incorrect fitting, incorrect product selection, unauthorised modification, unsafe operation, inadequate maintenance, worn equipment, unsuitable machinery or failure to follow safety instructions.

5. General Conditions

We may refuse, cancel or limit an order where reasonable and permitted by law, including where there is suspected fraud, website misuse, a genuine stock or pricing error, a safety concern, a supply problem, a payment issue, a marketplace error or another legitimate business reason.

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled item or order.

We may update, suspend or discontinue products, services, pricing, promotions or website content. Changes will not alter an order already accepted by us unless you agree, the change is required by law, or the original order cannot reasonably be fulfilled and we provide an appropriate option or refund.

We may apply reasonable quantity limits because of stock availability, supplier restrictions, safety concerns, suspected misuse, website errors or other legitimate business reasons.

5A. Product Specification Disclaimer

Product specifications, compatibility information, images and descriptions are provided as a guide and may be updated when manufacturers or suppliers change a product.

We take reasonable care to provide accurate information. Customers must nevertheless confirm suitability before purchase, including bar mount, pitch, gauge, drive-link count, chain type, machine compatibility, sprocket compatibility and intended use.

Guide bars, saw models, chain loops and aftermarket setups may vary from standard specifications. Previous-owner modifications, non-standard sprockets, aftermarket bar tips, worn components or different bar brands may change the required drive-link count or fitment.

Please contact us before ordering if you are unsure whether a product is suitable for your equipment.

6. Accuracy of Information

We aim to keep product information, pricing, availability and website content accurate and current. However, errors, omissions, stock discrepancies, feed delays, marketplace errors, currency-conversion issues or supplier changes may occur.

We may correct an error, inaccuracy or omission when discovered. If an error materially affects an order that has not yet been accepted, we may contact you to confirm the corrected details or offer cancellation and a refund.

If an accepted order is affected by an error or supply problem, we will contact you and provide options consistent with applicable law.

7. Pricing, Orders and Errors

Prices on our website are shown in Australian dollars (AUD) and include Australian GST unless expressly stated otherwise.

Our website currently accepts shipping addresses within Australia only. Customers outside Australia who use an independent freight forwarder must enter the forwarder’s Australian delivery address and complete the website checkout in AUD. Australian GST may apply because our delivery is made within Australia.

A third-party marketplace or payment provider may display an amount in another currency. Exchange rates, card charges, bank fees and marketplace conversion charges are controlled by the relevant provider and may affect the final amount charged.

Freight charges for delivery to the nominated Australian address are calculated separately at checkout unless otherwise stated.

Prices and freight charges may change before an order is accepted. The price applicable to an accepted order is the price confirmed for that order, subject to correction of genuine errors as permitted by law.

Submitting an order is an offer to purchase. An automated order acknowledgement confirms that we received the order but does not necessarily mean the order has been accepted. Acceptance occurs when we confirm the order for processing or dispatch, unless the circumstances clearly indicate earlier acceptance.

If a genuine pricing, freight, tax, currency, stock or listing error is identified before acceptance, we may contact you to offer the corrected order or cancel the affected item and refund any amount paid.

We will not knowingly rely on an incorrect or misleading displayed price. Nothing in this section limits any remedy available under the ACL.

7A. Promotions and Sale Terms

Promotions apply only during the advertised period and are subject to the specific terms displayed with the promotion.

Unless expressly stated otherwise:

  • Promotions apply only to selected eligible products and available stock.
  • Discounts do not apply to existing quotes, previous purchases, special orders, backorders, trade pricing or negotiated pricing.
  • Promotions cannot be combined with another discount, offer or coupon.
  • Freight charges are not discounted.
  • No rain checks apply after eligible stock has sold out.

We may correct genuine promotional pricing, stock, website or system errors. If an error affects an order before acceptance, we will offer the corrected order or cancellation and a refund.

We may change or end a promotion before an order is placed where reasonable, but we will not retrospectively remove an advertised discount from an order already accepted at that discount unless required by law or agreed with you.

Sale and clearance products remain covered by consumer guarantees. Separate change-of-mind restrictions may apply as explained in our Refund Policy.

8. Shipping, Delivery, Title and Risk

We currently ship orders only to delivery addresses within Australia.

Available delivery services, freight charges and estimated delivery timeframes are shown at checkout where available and are further explained in our Shipping Policy.

Delivery timeframes are estimates and may be affected by carrier delays, public holidays, weather events, remote locations, incorrect address details, marketplace processing, payment delays or other matters outside our reasonable control.

Customers are responsible for providing correct and complete delivery details. Additional freight or return costs caused by incorrect or incomplete customer-supplied details may be charged where reasonable and permitted by law. If the error was ours, we will cover the reasonable cost of correcting it.

Where tracking is provided, customers should monitor delivery progress and contact us promptly if a parcel appears delayed, damaged, missing, incorrectly delivered or not received despite tracking showing delivery.

Legal title to goods passes to the customer once payment has been received in full.

Subject to applicable law, risk passes when the goods are delivered to the nominated Australian delivery address, collection point, parcel locker, authorised recipient or other delivery location selected or approved by the customer.

If you request authority to leave, delivery without signature or delivery to a nominated safe place, risk generally passes when the carrier records delivery in accordance with that authority. This does not affect rights or remedies that cannot lawfully be excluded.

9. Orders from Outside Australia

We do not currently ship directly to addresses outside Australia. Customers in other countries may be able to purchase by engaging an independent freight forwarder that provides an Australian street address.

  • Independent service: You select and engage the freight forwarder. We are not affiliated with or responsible for the forwarder’s services, pricing, advice, storage, insurance, repacking, export arrangements or international delivery.
  • Australian checkout: You must set the shipping country to Australia, use AUD and enter the Australian address exactly as supplied by the forwarder, including any suite, account or reference number.
  • Domestic delivery: Our delivery obligation is to the nominated Australian address. Subject to applicable law, delivery and risk transfer are complete when the parcel is delivered there in accordance with your instructions.
  • Your agent: After delivery, the freight forwarder acts as your agent for receiving, inspecting, storing, repacking, consolidating, exporting and delivering the goods internationally.
  • Onward costs: You are responsible for the forwarder’s charges, international freight, insurance, import duties, tariffs, taxes, customs charges, brokerage fees and carrier handling charges.
  • Import requirements: You are responsible for checking that the products may be exported, transported by the forwarder and lawfully imported into your country.
  • Restricted products: Oils, aerosols, chemicals, batteries, Dangerous Goods, very long items and other restricted products may not be accepted. Confirm acceptance with the forwarder before ordering.
  • Returns: Any approved return must be sent to us in Australia in accordance with our Refund Policy. We can provide eligible return labels only from an Australian address.

To the extent permitted by law, we are not responsible for delays, seizure, refusal, loss, damage or additional charges occurring after delivery to the nominated Australian freight-forwarder address.

10. Special Orders, Non-Stock Items, Clearance Items and Custom-Cut Chain Loops

This section applies to special-order items, non-stocked items, supplier-direct items, made-to-order items, clearance items, discontinued items and custom-cut chainsaw chain loops.

Special-order and non-stocked products may be sourced specifically for a customer and may require supplier confirmation, upfront payment, freight costs, exchange-rate conversion or supplier restocking charges.

Custom-cut chainsaw chain loops are prepared to the customer’s selected pitch, gauge, cutter type and drive-link count. Once cut and joined, they may not be suitable for resale to another customer.

Clearance products may include discontinued stock, reduced-price stock, shop-soiled packaging, older packaging, limited-quantity stock or products sold at a reduced price.

These products cannot normally be cancelled, returned or refunded for change of mind, incorrect choice, wrong size, incorrect fitment, ordering error or no longer being required.

Where we agree to a discretionary cancellation or return, reasonable supplier restocking charges, return freight, payment costs, currency-conversion losses or other unrecoverable costs may be deducted from a credit or refund where permitted by law. We will explain any proposed deduction.

For a special-order product, a restocking charge of up to 10% may apply only where the supplier accepts the return and charges us a restocking fee.

Nothing in this section limits rights relating to faulty, unsafe, misdescribed or incorrectly supplied products or any other consumer guarantee.

11. Manufacturer Warranties

Some products include a manufacturer warranty. Warranty periods, conditions and claim processes vary by brand, product type and supplier.

A manufacturer or supplier may need to inspect or assess a product before a warranty remedy is approved.

Manufacturer warranties are provided in addition to, and do not replace or limit, rights under the ACL. Consumer guarantee rights may continue after the stated warranty period has expired.

Unless expressly stated in writing, Whites Forestry Equipment does not provide an additional voluntary warranty beyond an applicable manufacturer warranty and rights available under law.

Damage caused by misuse, incorrect fitting, incorrect sharpening, inadequate maintenance, worn equipment, impact damage, contamination, unsuitable cutting conditions, unauthorised modification, overheating, over-tensioning, inadequate chain lubrication, an incorrect sprocket or bar setup, or normal wear may not be covered by a manufacturer warranty or consumer guarantee.

12. Sharpening Services

Where we provide sharpening services, the service applies only to the item supplied by the customer for sharpening.

Customers are responsible for supplying items that are safe and suitable to sharpen. We may reasonably refuse items that are excessively worn, damaged, contaminated, unsafe, cracked, stretched, heavily rusted, incorrectly modified or otherwise unsuitable.

Sharpening may not restore a worn, damaged, stretched, overheated or poorly maintained chain to new condition.

We are not responsible for pre-existing damage, hidden defects or poor performance caused by factors unrelated to the sharpening service, to the extent permitted by law.

Customers must inspect sharpened products before use and must not use a chain, bar or cutting accessory that appears damaged, unsafe, incorrectly fitted or unsuitable.

13. Returns, Wrong-Size Orders and Customer Ordering Errors

Our complete return conditions are set out in our Refund Policy, which forms part of these Terms.

Change of mind: We do not provide an automatic refund because a customer changed their mind, found a product cheaper elsewhere, no longer requires it or made an ordering error. However, we may offer an exchange or store credit under our discretionary change-of-mind policy.

Fourteen-day request period: A request for an exchange or store credit because of incorrect choice, wrong size or incorrect fitment must be made within 14 days of delivery.

Return condition: To qualify for a discretionary return, the product must be unused, unfitted, uninstalled, unmodified, complete, undamaged and in resalable condition with its original packaging and protective coverings where applicable.

Fitment responsibility: Customers are responsible for checking bar mount, pitch, gauge, drive-link count, chain type, bar length, sprocket compatibility, machine compatibility and intended use before ordering.

Return and replacement freight: For a discretionary return, wrong-size return, customer ordering error or approved exchange, the customer is responsible for return freight and any freight cost to send a replacement.

Reasonable deductions: Where permitted by law, reasonable supplier restocking charges, return freight, missing-component costs, payment costs or other unrecoverable costs may be deducted from a discretionary credit or refund. We will explain any proposed deduction.

Exclusions: The discretionary policy does not normally apply to clearance items, special-order items, non-stocked items, supplier-direct items, made-to-order items, discontinued items, custom-cut chain loops, used items, fitted items, modified items, damaged items or products that are not in resalable condition.

Faulty or incorrect products: Where a product is faulty, unsafe, incorrectly supplied, not as described or otherwise fails to meet a consumer guarantee, we will provide a remedy in accordance with applicable law.

Assessment: All returns may be inspected. We may refuse a discretionary return that does not meet the published conditions, but a discretionary-return condition does not limit rights under the ACL.

14. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including rights and remedies under the ACL.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss caused by matters outside our reasonable control or by misuse, incorrect selection, incorrect fitting, unauthorised modification, unsafe operation, inadequate maintenance, unsuitable equipment or failure to follow instructions.

Where liability can lawfully be limited, it is limited to an appropriate remedy available under the ACL or other applicable law.

Nothing in these Terms excludes liability for fraud, wilful misconduct, personal injury, death or any other liability that cannot lawfully be excluded.

15. Dispute Resolution

These Terms are governed by the laws of Victoria, Australia, subject to any law that must apply regardless of this clause.

If a dispute arises, please contact us first so we can attempt to resolve it promptly and fairly.

For marketplace orders, returns, refunds and disputes may also need to be administered through the relevant marketplace process.

16. Payment

Orders are processed after payment has been received and cleared, unless we agree to other payment terms in writing.

We may cancel or delay an order where payment has not cleared, has been reversed, appears fraudulent, cannot reasonably be verified, has not received marketplace approval or has otherwise failed.

Payment may be required before we order a special-order, non-stocked, supplier-direct or made-to-order product from the supplier.

17. Changes to These Terms

We may update these Terms from time to time. The Terms applying to an order are generally those published when the order is placed, except where a change is required by law or agreed with you.

Updated Terms apply to future website use and future orders from the date they are published.
