1. Overview

This website is operated by Alphamare Pty Ltd T/as Whites Forestry Equipment.

Throughout these Terms, the terms "we", "us" and "our" refer to Alphamare Pty Ltd T/as Whites Forestry Equipment. The terms "you" and "customer" refer to any person, business or organisation that accesses our website, places an order, purchases from us, or purchases from one of our marketplace listings.

Whites Forestry Equipment operates as an online store with warehouse dispatch only. We do not operate a retail shopfront.

These Terms apply to purchases made through our website and, where applicable, to purchases made from Whites Forestry Equipment through third-party marketplace listings or sales channels.

By accessing our website, placing an order, purchasing from us, or purchasing from one of our marketplace listings, you agree to be bound by these Terms of Service to the extent permitted by law.

2. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, cancellation, or compensation for reasonably foreseeable loss or damage if a product or service does not meet a consumer guarantee.

This section applies to all parts of these Terms of Service, including every section, subsection, clause, promotion term, sale condition, return condition, disclaimer, limitation of liability, pricing term, stock availability term, shipping term, marketplace term, warranty term, service term and order control term.

If any part of these Terms appears to exclude, restrict or modify a right or remedy that cannot lawfully be excluded, restricted or modified, that part is to be read subject to the Australian Consumer Law and only applies to the maximum extent permitted by law.

Where there is any inconsistency between these Terms and your rights under the Australian Consumer Law, your Australian Consumer Law rights prevail.

3. Online Store Terms

You must use our products in accordance with all applicable laws, safety standards, manufacturer instructions and safe operating practices.

By placing an order, you are responsible for checking that the product is suitable for your intended use, including compatibility with your equipment.

If you are unsure whether a product is suitable for your chainsaw, guide bar, sprocket, cutting setup, machinery or intended use, please contact us before ordering.

3A. Marketplace Orders

We may sell products through third-party marketplaces and sales channels, including but not limited to eBay, Meta, Facebook, Google Shopping, or other online platforms.

Where you purchase from us through a third-party marketplace or sales channel, your order may also be subject to that platform’s terms, checkout process, payment rules, return process, buyer protection policies and dispute resolution procedures.

To the extent there is any inconsistency between these Terms and the applicable marketplace or platform rules, the marketplace or platform rules may apply to the administration of the order on that platform, including payment processing, messaging, returns, cancellations and dispute handling.

Your rights under the Australian Consumer Law continue to apply where applicable.

Product descriptions, compatibility information, specifications, pricing and stock availability shown on marketplace listings are provided as a guide only and may differ from our website due to marketplace formatting, listing limitations, data feed delays, system updates, currency conversion, listing errors or stock movement.

If you are unsure whether a product listed on a marketplace is suitable for your equipment, please contact us through the marketplace messaging system before ordering.

4. Product Safety

Products are intended for trained operators. Incorrect selection, fitting, use, sharpening, maintenance or handling may result in serious injury or death.

Chainsaw bars, chains, sharpening equipment, cutting accessories and forestry products must be selected, fitted, maintained and used correctly.

Customers are responsible for ensuring products are compatible with their equipment before use, including bar mount, pitch, gauge, drive link count, sprocket size, chain type, bar length, powerhead suitability and intended cutting conditions.

Customers must read and follow all applicable manufacturer instructions, safety warnings, machine manuals and safe operating procedures.

Customers should use appropriate personal protective equipment when operating chainsaws, sharpening equipment or forestry tools.

We are not responsible for injury, damage or loss caused by misuse, incorrect fitting, incorrect product selection, modification, unsafe operation, poor maintenance, worn equipment, unsuitable machinery, or failure to follow manufacturer instructions and safety procedures.

5. General Conditions

We reserve the right to refuse, cancel, or limit orders where permitted by law, including where we reasonably believe there has been fraud, misuse of the website, stock error, pricing error, safety concern, supply issue, payment issue, marketplace issue, or other legitimate business reason.

We may update, suspend or discontinue products, services, pricing, promotions or website content at any time.

We may limit sales quantities where required due to stock availability, supplier restrictions, safety concerns, suspected resale misuse, website error, marketplace error or other reasonable business reasons.

5A. Product Specification Disclaimer

Product specifications, compatibility information, images and descriptions are provided as a guide only and may change without notice.

We take reasonable care to provide accurate information, however customers must confirm suitability before purchase, including bar mount, pitch, gauge, drive link count, chain type, machine compatibility, sprocket compatibility and intended use.

Some guide bars, saw models, chain loops and aftermarket setups may vary from standard specifications. Previous owner modifications, non-standard sprockets, aftermarket bar tips, worn components or different bar brands may change the required drive link count or fitment.

Please contact us before ordering if you are unsure whether a product is suitable for your equipment.

6. Accuracy of Information

We aim to keep product information, pricing, availability and website content accurate and current. However, errors, omissions, stock discrepancies, feed delays, marketplace errors, currency conversion issues or supplier changes may occur.

Customers should check product suitability before purchase, including bar mount, pitch, gauge, drive link count, chain type and machine compatibility.

We reserve the right to correct errors, inaccuracies or omissions at any time.

7. Pricing, Orders & Errors

For customers in Australia, prices are shown in Australian dollars (AUD) and include GST unless stated otherwise.

For customers outside Australia, prices may be displayed in the customer’s local currency based on location, IP address, store settings, marketplace settings or payment provider settings. Overseas pricing excludes import duties, taxes, tariffs, customs charges, clearance fees and other government or carrier charges unless expressly stated otherwise at checkout or in writing.

Currency conversion rates may change and the final amount charged may vary depending on payment provider, card issuer, marketplace, exchange rate, bank fees or checkout settings.

Freight charges are calculated separately at checkout unless stated otherwise.

Prices and freight charges are subject to change without notice.

Orders placed through our website or marketplace listings constitute an offer to purchase. We reserve the right to accept or reject any order at our discretion where permitted by law. An order is not accepted until it has been confirmed and processed for dispatch.

We reserve the right to correct any errors, inaccuracies or omissions, including after an order has been submitted. Where a pricing, freight, currency, tax, stock or listing error has occurred, we may contact you to correct the order, cancel the order, or refund the order.

If more than one price is displayed for a product, or if a price is displayed incorrectly due to a system, typographical, supplier, feed, marketplace, currency conversion or website error, we are not required to supply the product at the incorrect price where permitted by law.

7A. EOFY Sale – Terms

Promotion period: The EOFY Sale starts 10:00am, Monday 8 June 2026 and ends 11:59pm, Tuesday 30 June 2026, unless extended, changed, or withdrawn earlier. All times are based on Melbourne, Victoria time.

Prices: Sale prices are as marked on our website. Discounts may vary by product, brand, category and stock availability. No coupon code is required unless stated.

Selected items only: The EOFY Sale applies only to selected products marked down on our website during the promotion period. The promotion is not sitewide unless expressly stated.

In-stock items only: The EOFY Sale applies to selected in-stock items only. Sale pricing does not apply to backorders, special orders, out-of-stock items, made-to-order items, supplier-direct orders, or items not available for immediate fulfilment from our stock.

Exclusions: The EOFY Sale excludes existing quotes, trade or negotiated pricing, prior purchases, backorders, special orders, lay-bys, rain checks, and any order already placed before the promotion period.

No backorders or rain checks: Sale pricing is available only while stock lasts. If an item sells out, we are not required to supply that item at the sale price once stock is unavailable.

Stock availability: Stock availability is not guaranteed until your order has been accepted, payment has been received in full, and the order has been confirmed for processing. Inventory errors, system errors, supplier changes, marketplace delays or simultaneous customer orders may affect availability.

Product changes: Additional products may be added to the EOFY Sale during the promotion period. Products may also be removed from the EOFY Sale at any time without notice.

Price changes: Prices may change during the promotion period. We do not guarantee a previously viewed price, advertised price, marketplace price or cart price unless the order has been accepted and confirmed by us. Pricing errors may be corrected at any time.

Sale may end early: We reserve the right to change, suspend, extend, or end the EOFY Sale early at any time, including due to stock levels, supplier changes, pricing errors, website errors, marketplace errors, system issues, freight changes or other business reasons.

Freight: Freight charges are not discounted unless specifically stated. Freight is calculated at checkout and may vary depending on order size, weight, destination and carrier availability.

Combinations: EOFY Sale pricing cannot be combined with other offers, discount codes, trade discounts, custom quotes, negotiated pricing or other promotions unless we agree in writing.

Order control: We reserve the right to limit quantities, cancel orders, refund orders, or adjust orders where there has been a stock error, pricing error, system issue, marketplace issue, misuse of the promotion, suspected resale misuse, or any other issue affecting the order.

8. Shipping, Delivery, Title & Risk

We ship within Australia and to selected overseas destinations.

Delivery options, freight charges and estimated delivery timeframes are shown at checkout where available.

Delivery timeframes are estimates only and may be affected by carrier delays, customs processing, public holidays, weather events, remote delivery locations, incorrect address details, marketplace processing, payment delays or other matters outside our control.

Customers are responsible for providing correct and complete delivery details. We are not responsible for delays, non-delivery or additional freight costs caused by incorrect, incomplete or unsafe delivery information provided by the customer.

Where tracking is provided, customers are responsible for monitoring delivery progress and contacting the carrier or us promptly if an issue arises.

If a parcel appears damaged, missing, incorrectly delivered, or not received despite tracking showing delivery, please contact us promptly so the matter can be reviewed with the carrier.

Legal title to goods passes to the customer once payment has been received in full.

Risk in the goods passes to the customer on delivery to the customer’s nominated delivery address, collection point, parcel locker, authorised recipient, or other delivery location selected or approved by the customer.

If a customer authorises delivery without signature, authority to leave, delivery to a safe place, delivery to a parcel locker, or delivery to a third party, the customer accepts the risk of loss, theft or damage after the carrier records delivery to that location, subject to applicable law.

9. International Trade

International orders may be displayed in local currency, but import duties, taxes, tariffs, customs charges, clearance fees or other government or carrier charges may still be payable by the customer unless expressly stated otherwise at checkout or in writing.

International delivery timeframes are estimates only and may be affected by customs processing, carrier delays, local import requirements, border inspections or other matters outside our control.

Customers are responsible for ensuring that products can be lawfully imported into their country or region before ordering.

We are not responsible for delays, seizure, additional costs, rejected imports or failed delivery caused by local laws, import restrictions, customs requirements, unpaid duties or taxes, or incorrect customer information.

10. Special Orders, Non-Stock Items, Clearance Items & Custom-Cut Chain Loops

This section applies to special order items, non-stocked items, supplier-direct items, made-to-order items, clearance items, discontinued items and custom-cut chainsaw chain loops.

Special order and non-stocked items are products ordered or sourced specifically for a customer and may require supplier confirmation, upfront payment, freight costs, exchange rate conversion or restocking charges.

Custom-cut chainsaw chain loops are made to the customer’s selected pitch, gauge, cutter type and drive link count. Once cut and joined, they may not be suitable for resale to another customer.

Clearance items may include discontinued stock, reduced-price stock, shop-soiled packaging, old packaging, limited-quantity stock or products sold at a reduced price.

Special order items, non-stocked items, supplier-direct items, made-to-order items, clearance items and custom-cut chain loops cannot be cancelled, returned or refunded for change of mind, incorrect choice, wrong size, incorrect fitment, ordering error or no longer required.

Where we agree at our discretion to cancel or return a special order item, any supplier restocking fee, return freight, payment fee, currency conversion cost or other unrecoverable cost may be deducted from any credit or refund where permitted by law.

For special order items, a restocking fee of up to 10% may apply where the item can be returned to the supplier and the supplier charges us a restocking fee.

11. Manufacturer Warranties

Some products may include a manufacturer warranty. Manufacturer warranty periods, terms and claim processes vary by brand, product type and supplier.

Manufacturer warranties are provided by the relevant manufacturer or supplier and may require assessment before a remedy is approved.

Any manufacturer warranty is in addition to, and does not replace, rights you may have under the Australian Consumer Law.

Unless expressly stated in writing, Whites Forestry Equipment does not provide an additional warranty beyond any applicable manufacturer warranty and rights that apply under law.

Damage caused by misuse, incorrect fitting, incorrect sharpening, lack of maintenance, worn equipment, impact damage, contamination, unsuitable cutting conditions, modification, overheating, over-tensioning, incorrect chain oiling, incorrect sprocket or bar setup, or normal wear and tear may not be covered by manufacturer warranty.

12. Sharpening Services

Where we provide sharpening services, the service applies only to the item supplied by the customer for sharpening.

Customers are responsible for providing items that are safe and suitable to sharpen. We may refuse to sharpen items that are excessively worn, damaged, contaminated, unsafe, cracked, stretched, heavily rusted, incorrectly modified or unsuitable for sharpening.

Sharpening may not restore a worn, damaged, stretched, overheated or poorly maintained chain to new condition.

We are not responsible for pre-existing damage, hidden defects, prior incorrect sharpening, stretched chain, damaged drive links, damaged tie straps, cracked cutters, broken rivets, worn depth gauges, unsuitable chain condition, or poor cutting performance caused by factors unrelated to the sharpening service.

Customers must inspect sharpened items before use and must not use any chain, bar or cutting accessory that appears damaged, unsafe, incorrectly fitted or unsuitable for use.

13. Returns, Wrong-Size Orders & Customer Ordering Errors

Change of mind: We do not offer refunds for change of mind, incorrect choice, incorrect size, incorrect fitment, ordering error, no longer required, or finding a product cheaper elsewhere.

Fitment responsibility: It is the customer’s responsibility to ensure correct product selection, including bar mount, pitch, gauge, drive link count, chain type, bar length, sprocket compatibility and machine compatibility prior to purchase.

Wrong-size goodwill policy: If a customer orders the wrong size or incorrect fitment, we may offer a store credit or exchange for the correct size as a goodwill option, provided the request is made within 14 days of delivery and the product is unused, unfitted, undamaged, unmodified, complete, resaleable and returned in original packaging where applicable.

Credit or exchange only: Wrong-size or customer ordering-error returns are eligible for store credit or exchange only. Refunds are not provided for wrong-size orders or customer ordering errors unless required by law.

Return freight: For discretionary returns, wrong-size returns, customer ordering errors or approved exchanges, the customer is responsible for return freight and any freight cost to send the replacement item.

Restocking fee: A restocking fee may apply to discretionary returns, wrong-size returns, customer ordering errors, approved exchanges, special orders or supplier-returned items. Where supplier restocking fees, return freight, payment fees or unrecoverable costs apply, these may be deducted from any credit or refund where permitted by law.

Exclusions: The wrong-size goodwill policy does not apply to clearance items, special order items, non-stocked items, supplier-direct items, made-to-order items, discontinued items, custom-cut chain loops, used items, fitted items, modified items, damaged items, or items not in resaleable condition.

Original packaging: Original packaging is required for discretionary returns, wrong-size returns, customer ordering errors and approved exchanges where applicable. The original packaging requirement does not apply where a customer is entitled to a remedy under the Australian Consumer Law.

Faulty products: Where a product is faulty, unsafe, not as described, or otherwise fails to meet a consumer guarantee, we will handle the matter in accordance with applicable law.

Our error: Where a return is due to our error, we will provide a remedy in accordance with applicable law.

Assessment: All returns are subject to inspection. We reserve the right to refuse discretionary returns that do not meet these conditions.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss arising from the use, misuse, selection, fitting, maintenance, storage, sharpening, delivery, delay or non-availability of our products, website or services.

We are not responsible for loss, damage, injury or cost caused by incorrect product selection, incorrect fitment, incompatible equipment, unsafe operation, lack of maintenance, worn machinery, modified equipment, unsuitable cutting conditions, operator error, failure to follow manufacturer instructions, or failure to use appropriate safety equipment.

Where liability cannot be excluded by law, our liability is limited to the remedies available under the Australian Consumer Law or other applicable law.

Nothing in these Terms excludes liability for fraud, wilful misconduct, personal injury, death, or any other liability that cannot lawfully be excluded.

15. Dispute Resolution

These Terms are governed by the laws of Victoria, Australia.

If a dispute arises, please contact us first so we can attempt to resolve the issue promptly and fairly.

For marketplace orders, disputes, returns and refunds may also need to be managed through the relevant marketplace platform process.

16. Payment

Orders will only be processed once payment has been received in full.

We may cancel or delay an order where payment has not cleared, payment has been reversed, payment appears fraudulent, payment cannot be verified, marketplace payment approval has not been received, or payment has otherwise failed.

For special order, non-stocked, supplier-direct or made-to-order items, payment may be required before the item is ordered from the supplier.

17. Changes to Terms

We may update these Terms at any time. The Terms that apply to an order are the Terms in place at the time the order is placed, except where a change is required by law.

Continued use of our website after changes are published means you accept the updated Terms.
